Yes the police were. They very rarely charge any of the numerous blockaders. Perhaps it is because Sizewell are so often in breach of their licence conditions. They have charged them twice (after getting 'permission' from British Energy) and both times the court cases collapsed.
It is not clear why the police are being directed by British Energy and not the Crown Prosecution Service on whether to charge people with a criminal offence.
