In Spain there is another serious problem facing property owners in Spain and it is in addition to the well publicised "Land Grab" law in Valencia.
The problem is the abusive application of the coastal law "ley de costas" 1988.
The ministry of the environment has to draw a coastline around the whole of Spain and any land and property which is between this line and the sea automatically becomes property of the state i.e. it is expropriated. Apart from the beach the area includes any land that has been flooded at any time in the far distant past or has a sand gravel or pebble base whether the sea ever reaches it or not. There is no max distance specified.
Once the property has been expropriated in theory you claim a right to continue to live in your old home until you die but you cannot sell it as it is not your property any more. This is deemed reasonable compensation by the Spanish constitution which fully backs the law.
If you ask for or are forced to accept indemnity you only get the value of the construction cost without regard to the land or location; this is completely unacceptable and it is only now that the Spanish themselves are prepared to say "basta ya " enough is enough.
Believe me this is no joke it is happening to us now and affects 10,000 other people.
In Jan 2008 an organisation called "Plataforma National de Afectados por la Ley de Costas (PNALC) www.afectadosleydecostas.com
was set up and is attempting to bring some justice into the situation and they have lodged a complaint with the European Parliament.
Until this situation is cleared up I would advise strongly not to consider buying property within 500 meters of the coast. Advise your (independent) lawyer.
good, no foreign person should own coastal land - it is a commodity that is far too valuable to be traded off to hapless dimwitted foreigners and it should be retained by the state just like what the English do with the Queens Chain. We have the Queens chain in Commonwealth countries and some fricken Engish speaker has the audacity to say something in a foreign land - piss off back to England or whereever you originated.
