Under Raich, Congress has the power to regulate activity that substantially effects interstate commerce, and the mandate falls squarely under that power, especially considering the provisions of the health insurance reform law that allow for purchase of insurance across state lines.

And the mandate is good policy to keep costs down, not that that has any bearing on the constitutionality.

And nope, Gonzales v. Raich, right the first time...

  • Though you make a point, you can't ignore that healthcare in this country needs change.

    My own health insurance premium is just over 300 per month, not because of any conditions I have but because of an injury i sustained to my back costing 50,000 in surgery when i was 16.

    What I ask is why did it cost 50,000 for 1 week in the hospital and 1 day of surgery.

    Something needs to change and the industry isn't doing anything about it.
