@accidentalM0nK3Y no dude you're wrong, yes you can buy the TP @ lots of online sites including Amazon, plus there have been two major updates released recently, 3.0.4 & 3.0.5

hardware means they wont be making anymore Touchpad, but they will keep updating the software.

How can you not mention the best tablet that was on the market at that time? The ASUS Eee Pad Transformer. And now the Transformer Prime with it's super slim design, aluminum construction, and quad-core processor is taking over the market. Just try to find one.

HP Touchpad? Unless I've missed something, that's still discontinued. They sold all new ones way back in the year for $99 after stopping hardware development for WebOS. After a quick Google it seems they did the same with refurbished models a few days ago selling to HP employees first before putting the rest on eBay.
Basically, you can't buy a brand new HP Touchpad anywhere and even if you managed to find a used or refurbished one you won't be getting any updates for it.
