David Shuster, host of Take Action News, announces the Supreme Court decision to uphold the Affordable Care Act--ObamaCare--live on the steps of the Supreme Court. Health care reform supporters erupt in cheers behind him. Shuster was among the first to announce that the Court ruled the law's individual mandate provision constitutional.

    You are right, the commerce clause of the constitution doesn't allow the gov't to force people to buy something or pay a penalty, and the SCOTUS ruled that way (hence the initial misunderstanding at CNN and FOX NEWS). However, under congress' power to tax, the law is constitutional.

    So part of the healthcare law is a new tax on everyone, however if you have health insurance you are exempt from this tax. It's more than just semantics because this limits congress power thru the commerce clause.

    You have it exactly backwards. This is no different than charging a tax penalty for everyone who isn't married. There is no requirement to be married just as there is no requirement to spend money on various insurance policies.

    This is no different than giving tax breaks for married couples over single people, or giving tax breaks to people with children over people without children. If you have healthcare, you will get a tax break and if you do not, you have to pay taxes. No one is making you buy anything, just like no one is making you get married or have children.

    This just shows how the Scotus no longer considers the Constitution, but has become just another political body. NOTHING in the Consitution allows the Federal Government to issue Tax Penalties based on what is privately purchased. The fools who are cheering don't even realize their freedoms are now lost to RIGHT-WING FASCISM. YOU MUST NOW PURCHASE PRIVATE PRODUCTS BY LAW. WELL, I WILL NOT.
