Cop perjury charges filed 7/13/09! Phoenix, AZ Police - Harassments through Illegal Arrest 8/07/09!

Around 2:00pm Friday, August 7, 2009, my boyfriend (black male) and I were arrested because of supposed identification issues. My boyfriend and I had taken our previous cases to court in June and won. At the same time through a two day trial, I caught the cop (racist cops in AZ. Please do research on Sheriff Joe Arpaio.) doing perjury on the stand (assisted by the Prosecuting Attorney's Office). And since I filed charges against that cop and I have a hearing this Tuesday for the perjury charges against him, my boyfriend and I have been harassed and pulled-over three times.

The cops supposedly arrested my boyfriend with supposed resisting arrest and disorderly conduct. When in fact, my boyfriend never resisted arrest and it was the cops who were disorderly conduct since the time before they pulled me over (undercover cop admit following us for at least two miles before the initial two cop cars finally pulled us over 'cause according to them, it was my auto plate in the rear of my car window the reason they pulled me over - not against state vehicle codes). And the reasons they harassed my boyfriend (racial profiling) was simply because he did not show them his identification - he was the passenger. Neither my boyfriend nor I were committing, or about to commit, any crimes. And therefore, the cops had no rights or jurisdiction to demand for his identification. My boyfriend was within his legal rights to refuse.

Further, while we were in the transportation vehicle to go to jail, my boyfriend explained that they supposedly found 3 warrants for his arrest. However, the only thing that matched on those warrants was his date of birth - not the first nor last name matched my boyfriend's name. In addition, the state the cops claimed where my boyfriend had these supposed warrants; he never even visited that state.

I was finally released today on OR but they still have my boyfriend in jail and I'm very concerned for his well-being; he has seizures caused by lack of sleep.

My boyfriends' mother just explained to me that my boyfriend called her stating he did not get OR (he does not have any priors and he's employed) and that she posted bail already earlier this morning.

While I was in jail, I did not nor could not sleep. They placed 28 women in a holding cell in the size of a living room; it was very cold, women were cuddling with one another to stay warm, and even using toilet paper as blankets and on the cement floor for warmth - because the guards refused blankets. In addition, they mixed the drug addicts, mentally ill, homeless people who may have illnesses, people with criminal history, and people with no criminal history, together. There was also a frail old woman at least 70 years of age who claimed that two deputies threw her face down to the ground then kicked her - all because she explained that couldn't be exposed by the sun because of her seizures and medications. She had a big swollen whelp on her left cheek and above her eye. She was in the holding cell for at least 3 minutes till she finally fainted and hit her head on the toilet seat. It took approximately 10 or more minutes before the deputies finally arrived to help her. I finally saw this frail old lady in court today. She had a sling on her arm.

While that is horrible, the men had it bad, too! Their rooms were smaller and they were more packed in their holding cells. And I know my boyfriend could not sleep - it was so crowded, most men were sitting - there was no room to lay down. [Reminder: no beds in holding cells.] [ Our meals were only twice a day and we received the exact same meal every day - bread, peanut butter, donut, cookie, orange, and juice - all in a plastic bag. All sugar and not a balanced meal, whatsoever].

The cops also towed my car, confiscated my laptop, camera, cell phone, driver license, auto insurance and registration. They also confiscated my boyfriend's cell phone, over $200.00, etc. Further, they stated they will not release my car for 30 days . And they withheld our property until we went to their impound. My cell phone, driver license, and car has yet been returned!

All against the United States Constitution: Amendment 4 - Search and Seizure.

Currently, I will be going to court first thing Monday morning to subpoena my personal belongings. In addition, I have hearings on August 11, 18, 19, 26, and 28th - all based on the cops harassments. If anyone knows of an attorney who may be willing to help with a 1983 act for my boyfriend and myself, it will be highly appreciated!

another thing they cant search the car with consent but they can get a drug dog if they have a probable cause they can search or if they feel the drug dog right they can now search it and if they find anything illegal then they have the right to arrest but for a illegal search they find anything at all they arrest you on illegal search then you can win in court

@jesselyle2186 You're completely incorrect. Whether the cops "suspect" you having drugs or not, they can only search your vehicle if they have your authority. Imagine cops breaking into your home because they "suspect" you for smoking marijuana, or any other illegal activities - imagine the chaos because we allow the government have that type of control over the people - it does not exist because of the Constitution. Please NEVER forget and educate yourself!

you have to showw id if your in a car even if not unjustifiable pullover once they come up with a reason if they dont come up with one then you dont have to show i know that once your in a car driver seat they can see if your driver or not lol its stpuid i know but they do that

@jesselyle2186 Ironically, these cops are from the same precinct that has harassed the passenger and I on 7 occasions. This incident is only because I was ready to go to court against their fellow officers for perjury in 2 days. Moreover, even if I didn't have any identification, their only authority was to write me a citation because of "Proper Due Process" - I am innocent until proven guilty by a court of law. Further, the cops writing me a citation is my "evidence of identification".

Great job in taking the video! I'm surprised the officers didn't bust the camera as they usually do. Glad you won the case and showed these cops to think before they involve in any stupid actions. Everyone needs to know their rights and the laws in general so the public keeps these abusive police in check. Some cops are really great people and actually serve to better the public, but then there are those who continuously harass and mock people. Great job, keep em' in line!

I wasn't aware of this until I married a black man and tried to fight for my rights - what a nightmare! But it's okay, the nightmare is worth every second of it knowingly I am fighting for my children, all our children's rights! Amen!
