  • can you tell in advance if the bank has a note (or a copy of it)?

  • No, most will have a copy of it for sure but smaller banks and credit unions will have faster access to their original notes. Larger institutions will have a harder time producing the original note because of the volume of transactions they handle.

They have the county recorded and notarized documents of the trust deed , grant deed and promissory notes..it will be easy to prove that you ( the borrower) has breached and defaulted by non payment. The best you could hope for is an excrow account be established by the court that you must keep paying the rate of your contract until the owner is found and steps up to the plate. Can you keep paying? Didn't think so. You just want free rent.. fail
