it is still an open issue whether password controlled sites or moderated sites with express terms and conditions can be regulated. @ihatekate08 you say you are in the military, consider, could you say whatever you pleased during bootcamp? No, when you were ordered to be silent you were. That is censorship as much as moderation is. Consider government provided info on abortion. Not everyone can force the government to print pro- & anti-abortion information in the information provided to clinics.

they cannot. The traditional public forum are those areas historically associated with free speech, such as parks, town squares, and streets. In these areas all government actions come under strict scrutiny where they must show a sufficiently important state interest that is accomplished by the most narrowly tailored means--censorship has almost never passed this test.
Now, the Internet is largely treated like a traditional public forum when it comes to public networking sites, however

@ihatekate08 you're completely wrong. The First Amendment protects persons from state actors infringing on their right to speak. However, even that right is not without exception. The First Amendment involves what is called "forum analysis" wherein, depending on the forum, the government can constitutionally restrict different levels of speech. Consider that in a non-public forum the governmental can create nearly any legitimate, content-neutral regulation they want. In traditional public forums

@Cadet35014 Technically it is. Telling people what the can and cannot say whether its your forum or not is infriging on the first amendment. While i do agree that theres a difference between having the right to say whatever you please and being a dick, i still believe you have the right to say whatever you please. But maybe hats just me. What could i know? Im just an ol' Jarhead full of bullet holes and shrapnel lol.

@ihatekate08 "Free speech" is different that "things that are listed as not to be discussed on the forum". I was referring to people bringing up topics that are specifically not allowed then claiming their free speech is being infringed upon.

@Cadet35014 The First Amendment is general, public, private or otherwise. If a person lives in the US and the business they're speaking out against is based stateside, your covered by the first amendment. Seeing as how freedom of speech is part of that amendment, I'd suggest you study up young blood.
