Why has the Barack Obama Department of Justice decided to continue obstructing proper civil court proceedings by reissuing the claim of "state's secrets" in denying evidence necessary to allow a case to go forward in the United States Court of Appeals for the 9th Circuit against Jeppesen Dataplan, a subsidary of Boeing Corp. Five men have sued a government contractor for extraordinary rendition and torture, and the Bush administration invoked the claim of "state's secrets" in order to withhold evidence in the trial. When the trial resumed under the Obama administration recently, the judge
asked if anything had changed that would allow the trial to proceed. DoJ lawyers said no, and the ACLU representing the men want to know why.
