That IS disorderly conduct, regardless of who is doing it. The first amendment does not cover creating a hazardous or physically offensive condition by any act that serves no legitimate purpose. Most libertarian would have been angry that this cop arrested this man because he expressed his first amendment freedom of speech. A libertarian would have suggested that the cop should have left this guy alone after he showed and presented his identification. If the situation were reverse and a white conservative Republicans president said the same thing, we would have been considered a "sane" person. This black cop would have been made to do traffic duty and would have asked to apologize to a white professor, a friend of the president.
