Just when you thought progressives couldn't get any dumber, they go an pull a stunt like this. Supreme Court Nominee Elena Kagan dodges a question by Sen. Coburn who asks her if she would consider a bill that requires American citizens to eat 3 vegetables a day unconstitutional. Miss Kagan, you're absolutely right that judges should not base their decisions on whether or not a law is dumb...they should be judging it on whether or not it is CONSTITUTIONAL!

  • So you guys are outraged at the notion that the government could suggest to parents and children ways to eat a healthier diet, b/c that's WAY too much intrusion ("Keep your hands off my food!!").

    And you feel it is vital for the govt to tell us what plants we can't smoke, who we can go to bed with, who we can love/marry, and how doctors should treat female patients.

    If that's the logic with which you make decisions, I would recommend just not voting at all, please!!!!

  • Oh yeah it is Constitutional to say you have to eat three fruits and vegetables> NOT. That COMPLETELY violates the principles of liberty

  • @ShamusMcfitzy The fed. courts have an obligation to strike down unconstitutional laws. There is nothing in the enumerated powers granted to the fed. gov't which gives it any authority over healthcare in general let alone give it authority to require the purchase of health insurance,hence the recently passed healthcare law should be struck down. Also since I do not believe that the federal courts have a monopoly on the reviewing of federal law, the states too may nullify unconstitutional laws.

  • @sleedolfine15 Oh, so we should expect judges to uphold the law. So if there were such a law, Justice Kagan should uphold it? The problem with modern conservatism is that you don't want to uphold the law any more than liberals, you want to repeal constitutional laws that you disagree with. If Congress passed that dumb law, upholding it in the SCOTUS would definitely not be "nonelected legislating", it would be almost the opposite (although striking it down as unconstitutional would be just).

  • really though, how do you respond politely to such ridiculous hypotheticals when they're not even analogous to the issue at hand? she politely admitted that, indeed, that would be dumb, but what does that have to do with the price of rice in china, senator? how do you answer such stupid questions? there's been a national food pyramid since forever, funny we only subsidize the foods at the top--sugar and shit-- effectively pricing fruits and veggies out of reach of the everyday fat american.

  • @RussAbbottCC I would argue that there is nothing extreme about expecting judges to actually base their rulings on the actual law of the land. Otherwise they are not judges,but nonelected legislators. She was given enough time to call it a "dumb law",but not enough time to call it an unconstitutional law?There is Scalia & Thomas. Besides,there's an organization called the Federalist Society which is filled with constitutionalist who can be put on the bench. But,first Kagan needs to be stopped.
