Settlement: OC laborers can seek jobs from streets

The Associated Press
08/27/2008

SANTA ANA, Calif.—A settlement between day laborers and the Orange County sheriff's office calls for authorities to acknowledge workers' rights to seek work while standing on sidewalks, according to attorneys for the laborers.

The settlement was reached last week, but attorneys did not release details until Wednesday. The agreement stems from a federal harassment lawsuit filed last year by about 50 day laborers against the Sheriff's Department, the county and several individuals over a Lake Forest city ordinance that barred workers from soliciting work on street corners. The city later repealed the ordinance and was dropped from the lawsuit.

The lawsuit alleged deputies violated workers' right to free speech by telling them they couldn't seek work on a street corner. In court papers, deputies said they were responding to residents' complaints that workers were littering and trespassing.

Under the terms of the agreement, the Sheriff's Department agreed that "people have a right to offer themselves for work," and affirmed the right of contractors to solicit workers as long as no law is violated, said Tessie Borden, an attorney with the American Civil Liberties Union, which represented the workers.

Borden said the case "was not just a challenge of an existing ordinance. This goes further, establishing an existing and inviolable right."

According to the agreement, the sheriff's office admitted no wrongdoing and retains authority to enforce
laws that prohibit jaywalking, double parking and littering.

S. Frank Harrell, an attorney for the deputies, was not immediately available for comment Wednesday night.

  • So they wouldn't have any civil liberties? I highly doubt that is exactly what they were trying to do but the lady should have been more specific instead of distorting their intentions with changing the law.

  • @VronRN2 i hope u die

  • ACLU - American Communist Labor Union.

The more illegals you have, the more slaves for the state.

Hey, can I pitch a tent in the middle of your party, slam some whiskey, get some hookers, and crank up the Metallica? No? Well, fuck you, I don't need your permission, I'm a citizen of the continent and can go wherever and do whatever I want.

  • A victory against the harassment of day laborers ...

  • by a red neck?

  • u dont like mexicans in this country , but u choose a name like ohio "desperado"? ur a straight fag, fucken moran! fucken mexican lover!

  • Are you KIDDING ME?!?!?!?!

They are in the country illegally. They have no civil rights. They are NOT citizens of the United States. I am so sick of this argument that the illegals rights are being violated. If they were citizens, they would have rights.

  • mmmhhh! Carne azada! Ya se me antojo! I bet that all minutemen are going to wish they were day labor workers when they see this video of happy people eating TACOS! hahaha!

  • I agree with you.

It's also futile to think that you are going to rid this country of illegal aliens.

Just taking your logic a step further...

  • ...and a comment like that makes you better than an illegal alien?

Talk about defeating your own purpose. Thanks for posting that, though. It shows you are no better, if not worse, than them.
