ISLAMABAD: While heirs of the victims of Raymond Davis are losing hope, experts say only the courts can bring the killers of the third Lahore victim out of their hiding in the US consulate in Lahore.
The huge controversy over the Davis fate has clouded the death and given space and protection to the killers of Ibadur Rehman, who was hit by non-diplomats in a car that escaped from the scene after the crime. Some experts suspect that if urgent action against them is not taken, the US authorities my quietly smuggle them out of Pakistan, if they have not already been taken away.
According to reports the US consulate has refused to hand over the killers of third Pakistani. Punjab Law Minister Rana Sanaullah has publicly said that the Consulate had been asked by the Punjab government to hand over the vehicle and the driver responsible for death of motorcyclist Ibadur Rehman minutes after Davis had shot dead two persons on January 27.
Well placed sources in Interior Ministry told The News that the Interior Ministry has not contacted the US embassy or the consulate to hand over the killers of Ibadur Rehman to the police.
Maria Sultan, defence analyst and Director General South Asian Strategic Stability Institute, says that section 7 of the Anti-Terrorism Act and Section 320 of Pakistan Penal Code apply to the killers who are being protected by the US consulate. She said that if the embassy or consulate refuses to hand over the killers of third Pakistani then the court can take up the case and issue a search warrant of the embassy/consulate.
She said that Pakistan can also knock at the doors of the International Court of Justice where it can be claimed that the embassy was protecting persons wanted for terrorism and murder. Azhar Siddique Advocate, a public interest litigation lawyer while talking to this correspondent said first the foreign office should write to the embassy/consulate to hand over the vehicle and killers of Ibadur Rehman. He mentioned that if the embassy refuses to hand over the killers then Pakistan should write to the US State Department and after that court should be moved against the US Embassy/consulate.
"The court can issue search warrants of US embassy/consulate but it will happen for the first time," said the lawyer adding that so far no positive development has taken place since the incident.
He said that those who hit Ibadur Rehman do not enjoy immunity and Americans know it therefore they were not handing over the killers to the police. The lawyer said that Pakistan can also move International Court of Justice and claim that the killers of innocent citizen should be handed over to it because America was misusing the diplomatic immunity.
Some media reports have already said that the American driver and other riders of the Lahore Consulate whose vehicle killed a third Pakistani have already escaped and left Pakistan. Raymond Davis has told authorities that there were four US citizens that came in the back up vehicle.
Acting US spokesperson Courtney Beale, as reported in the international press, did not deny the question regarding the escape of killers of Ibadur Rehman from Pakistan. "We would like to point out again, something that is not being stressed strongly enough. The US citizen acted in self defence," Beale was reported to have said.
