On FreedomWatch, Andrew Napolitano and Lew Rockwell talk about the principles of Nullification, Secession and Interposition.

If the federal government were trying to do something within a state that was unconstitutional, the state government could say - you have no jurisdiction to do something illegal within our state.

Nullification has a long history in the American tradition, and as Napolitano points out, it was used in Massachusetts to resist the abhorrent federal fugitive slave act in the 19th century.

  • If the federal government passes a law that is unconstitutional the state legislature just simply writes a resolution, passes it in both houses, then sends it to the be signed by the governor telling the federal government that the law does not exist in the state. No Supreme Court case, no lawyers, the state simply says no.

  • @NYredwhiteandblue, It would be unlawful to force anything against ones will, though if all the states succeed from the federal government, where would that leave them.

  • not entirely, the states cant be held responsible for what the federal gov't does with money that it has borrowed. and each state could just start trading goods with eachother, which could create jobs.
