@Enoemen He's just makeing a high minded ,definition of punishmet according to whats written in the constitution avoiding the real legal issue of whether any laws were broken,theres not only US law but international law against it when dealing with enemy combatans and once a treaty is sighned and ratifyed it becomes our law as well !
Scalia is full of it. Alexander Hamilton, whom he so deeply admires, did not allow any torture of British soldiers during the Revolutionary War. Scalia knows nothing, I'm ashamed he spoke at my high school graduation. How would he like it if he were arrested and tortured? Well as long as they're not 'punishing' him, I guess it's perfectly legal.
Punish - "to suffer for offence". The detainees are made to suffer for the offence of not giving their torturers the information they want. A similar case would be a parent punishing their child for not telling the truth.
