Verapat Pariyawong, then a senior law student at Chulalongkorn University, participated at the 2007 Asia Cup International Law Moot Court Competition, organized by International Law Student Exchange Council of Japan (ILSEC) and sponsored by the Ministry of Foreign Affairs. The Competition was held at Mita Conference Hall in Tokyo, August 2007.
Verapat, along with his teammate, Chawatak Ardnaseaw, argued for Applicant, the State of Alstaat in an international dispute concerning the obligation to extradite a war criminal suspect. The setting was the International Court of Justice (ICJ).
The Respondent was the State of Rodmania, who was demanded by Alstaat to extradite Dr. Hattin, a medical doctor who allegedly mutilated limbs of Alstaat soldiers during a previous armed conflict. Dr. Hattin was seeking asylum in Rodmania and claimed that he performed mutilation which was required to save lives of the wounded soldiers.
Agents of Alstaat submitted following legal arguments pursuant to principles of public international law:
1. Rodmania is obliged under International Humanitarian Law to extradite Dr. Hattin
particularly under the third Geneva Convention of 1949 and the first Additional Protocol of 1977
2. Rodmania may not claim refugee protection for Dr. Hattin under the Convention Relating to the Status of Refugees
3. Rodmania is obliged under the United Nations Charter to cooperate in preserving international peace and security by extraditing Dr. Hattin
