Oh, and don't forget to check with Cass Sunstein, since he happens to be on Obama's campaign as a legal advisor. From Free Markets & Social Justice:
"The relevant provisions allow the president to discharge the commissioner 'for cause'...allow[ing] him to remove officials under certain circumstances...the president has very broad removal power over the commissioners of independent agencies...They are not, as a matter of statutory law, 'independent' of him at all."

Uh, yes he can.
Humphrey's Executor v. United States: "any commissioner may be removed by the President for inefficiency, neglect of duty, or malfeasance in office."
The case is from 1935, not 1939.

Uh, no he cant. See the Supreme Court decision of 1939.
The SEC Chairman is part of an independent counsel (hence independent). The best McCain could do is ask him to resign, which the chairman could ignore.
