John suffered multiple injuries when he fell 28ft on to concert.
In the beginning excepted injuries were as followed..
Date of accident June 23rd 2005
December 7th 2006 Decision letter..
1. C6 Burst fracture
2.Compound comminuted fracture of the left olecranon ( elbow)
3.concussion, skull fracture
4.Left hip fracture
PROTESTING AND FIGHTING FOR 1 YEAR AND AFTER HE WAS TOLD WERE SORRY WE MISSED.
Mr Berfelo's Injuries that have been accepted now are as follow

1.Left -ankle fractures and strains
2.Brain -Mental disorder or syndrome
3.Brain- Mental disorder or syndrome, uns
4.Brain- Concussion
5.Cervical Verterbrae-C6 bust fracture
6.Cervical Region - Chronic pain
7.Elbow left -Factures
8.Elbow left - Chronic pain
9.Hip left - Factrures
10.Knee left - Other Diseases conditions, disorders
11.Skull - Fractures.
DENIED ON CLAIM BUT RELATED TO FALL June 23 2005
1.Cervical Region - Dislocated, Herniated, Slipped, Ruptured DISC
2.Ears - Other Diseases conditions , disorders
3.Lumbar Region- L3-L4 Dislocated, Herniated, Slipped, Ruptured DISC
4.Lumbar Region- L4-L5 Dislocated, Herniated, Slipped, Ruptured DISC

It has been 4 years and just in the past 2 months John has recived more 9 DENIED LETTERS
retaining to his WorkSafe B.C claim
The most recant July 14 2009
It states that he can work as a
1. Parking lot attendant $2460 a month
2. Toll booth attendant $24690 a month
No loss of earnings pension
This is how seriously Injured workers are treated..
27.65% total disability award for injuries
Monthly Salary $ 5000+ WorkSafe B.C pays MAX $3240 - 27.65%= $927.22 WorkSafe B.C PENSION $ 955.11 2009

Be in charge of your case. WCB has 100's of cases, you only have 1. So how can they focus on you as well as you can? Stay on top of it on a daily basis. These are your benefits and rights. If it takes 10 phone calls in one day, so b...e it. Keep a list of EVERYONE that you speak to. Record names, dates, times and the topic/answers.

Hey, did you phone the Merchant Law group in Regina? I just did and the lawyer is suppose to return my call. As of now, WCB is threatning to cut me off if I don`t go to school for a different career since I can`t go back to what I loved to do. This is twice now that the physios who are run by WCB, has screwed my knee with their physio tactics and here I sit to be blamed and threatened....I just don`t understand???

This is how the system treats injured workers. It is not you it is the SYSTEM.. Now EXPOSE what and how you are being treated.. If you sit back and think it will all work out then you are only kidding you self.

Thay treat you like a rat in a cage and after awhile we start to think it was our fault. IT IS NOT YOU ITS THEM !!! ASK EVERYONE!!

Hey I was informed today from another injured worker, to try for CPP long term disability. Have you tried this route? If so, how did it work out for you?

Yes I have gone through this all ready and if you have not settled with WorkSafe yet i would advise you not to, If you do they deduct it off your long term disability , And remember when you turn 65 WorkSafe cuts you off that is when you will need CPP. DO NOT APPLY YET !!

I feel your pain. I have bulging disc on L3,4,5 & S1, Si joint pain all on my left side. I also recently had an knee allograft from a donor on my left knee. WC says I can go back to work and gave instructions for me to stand every 15 minutes to alleviate back pain.

My Experience's under The WCB Policy is That The Agents LIE CHEAT & FRAUD.

The WCB Brochures are Full Of Bullshit ! Its sales: Really Fraudulant Advertising.

The WCB Contracted-OUT Mc-re-hab Services Clinics GETS PAID OUT FOR FRAUDULANT REPORTS.

The 3rd party Patients (you) do not get copies .The WCB is the paying client !

The WCB INSURANCE POLICY Helps protect Employers from Getting Sued !

These medical consultant really work you over - they are dishonest and in receipt of payola from the WCBs - If your rep has been trashed by these quacks, you have to go to RATEMDS and make a comment, over the last year, dozens of these charletans have had their Proffessional reputation thrashed by dozens of WCB clients, they fear having their credentials slammed- because they will never be able to get a client outside their WCB gravy train

Hope things are better for you and you're out of pain. I fractured T4 T5 T6 and herniated L5-S1 so I know what you have been through. Mine was military related so I didn't have your struggle there but I know so many who have. Just keep fighting them.

This is just great. After my third knee surgery(pcl), Physio`s stretched pcl too far trying meet wcb`s demands. WCB says my knee is only 4% damaged and compared it to a "Zit on my ass". Now surgeon says my knee totally screwed. Now WCB cut my pay from $1900/month down to $800/month. They are using the: "Lets starve him back to work" method. No wonder, people want to walk into their building with a gun!!!!

I talked to Ernie Chabonole from the Merchant Law Group, he said they take WCB claims all the time. As of right now, ALL injured workers reading this, there is a Harper youtube blog to post questions towards the Prime Minister. Better get on there and post away, I did.

Let me know if any Canadian lawyer will actually take the WCB on. I have tried lawyers from Edmonton to Winnipeg, including Merchants, and once they find its with the WCB, their whole attitude changes.
