The point Tony Perkins is trying to make at 11:20 is a perfect example of the flawed logic David Boies discusses so articulately at 10:00. The statement, "There is no conclusive evidence that suggests children who grow up [with gay parents] fair as well as childred who grow up with a mom and a dad."

He offers this as reason for opposition, while it's the precise flawed logic Boies alludes to. The lack of conclusive evidence is the precise reason the judge made his decision.
