mmm may be not stole the song exactly, just the idea about use it on a game, but the song it´s free about rights (wathevert is ugly do that....agree with you in that point)

Stealing? I don't think so. Rareware also used "Funeral for Queen Mary", which was composed in the 17th century, for the intro to Conker's Bad Fur Day (which parodies A Clockwork Orange). I'm sure the copyrights for all these songs expired many, many decades ago.

Grim Fandango was released in 1998... Donkey Kong, in 1999. Probably Rareware stole from Lucas Arts.

I heard this exact same song in Donkey Kong 64. But surely they didn't steal it from Grim Fandango. Rareware sometimes puts old music in their games. This song is probably some piece from the early to mid-20th century.
Remembers me to the good old times, when the game crashed at the scene with the bees xD
