  • This pit has tested positive for diesel range hydrocarbons. Revealed in a TPH test, total petroleum hydrocarbons, diesel fuel was used in some phase of the drilling, fracking, and/or completion process. However, the Texas Railroad Commission has been indifferent, and the TCEQ has never responded to an online complaint filing. Where are the regulators?

  • mcjacktwo, if you are listening, please elaborate. I cannot get anyone to explain this to me. The regulating authorities seem to be reluctant to answer this question. Could it be that it is a common practice to do this and nobody wants to talk about it?

  • Although the 2005 Bush-Cheney Energy Policy Act exempted hydraulic fracturing from the Safe Drinking Water Act - aka the "Halliburton Loophole" - diesel fuel is not exempt. If benzene, toluene, ethylbenzene, and xylene, etc. have been found at this site that's evidence that diesel fuel is being used. Clearly a violation of Safe Drinking Water Act.
