Giulietto Chiesa, an Italian member of the European Parliament, said to RT Georgian president Saakashvili had no legal right to have a European flag behind his back declaring war to South Ossetia.

Good point the Council Of Europe flag is same as EU flag. The comment below made me realise. I always wondered.

This is something that has caught my attention as well. However, the flag behind Saakashvili is in fact not the EU flag, it is the flag of the European Council, an institution of which Georgia became a member on April 27, 1999. The flag is similar to the one used by the European Union. Technically this means that the flag can be used by the Georgian government but it does give a misleading impression.
