You make a good point. It would be great if the case made it to the supreme court. I still think we should repeal prop 8 though, because people should not have to wait for equal rights, and leaving it up to the courts is somewhat of a gamble.

You can't force them any religion to marry any one now Straight or Gay that is just to take away the argument that people like NOM use to spread lies and misinformation. I don't think the US supreme court will allow prop 8 to be over turned. There are other court cases moving forward that can still be ruled on in the federal court. So not moving forward here in CA with our system is a waste of opurtunity.

I tend to agree with you.. The whole thing was quickly put on the ballot here in Ohio in '04 when Bush ran for his second term. (Ironically by a gay man named Ken Mehlman- INCREDIBLE!!) Ours not only forbids marriage but also civil unions. I don't think people even read it before they voted. It was called "the Protect Marriage Act.' So basically here in Ohio we have nothing. Legally my partner and I of over 20 years are no more than complete strangers.. So sad and so unfair!

Kinda off topic but...
This may be one of the reasons why I think increased states' rights (libertarian-ism/Tea party-ism) is a bad idea because it grants them the powers to take away rights from the people. I also think that... RIGHTS SHOULD NOT BE VOTED ON THAT IS WHY THEY ARE CALLED RIGHTS! I much rather wait and have this go to the U.S. Supreme Court and have gay marriage legal on the FEDERAL LEVEL & invalidate every freakin' states' law that bans gay marriage.

@jonescity totally agree, rights should never be voted on! But that is why the courts exist to protect the minorities from the tyranny of the majority
