The reason this question about lower charges is this:
I dont know if you have even been on a jury but I have. I learned while on a jury that people tend to look at facts and listen to statements and see and heard different things, from very different points of view. I learned that no matter how you feel you are right you have to allow for others who disagree and there is a great likelyhood that a jury might have to find a lower charge in order to get all 12 votes they need in agreement.
That's a good question. I don't think so. He did commit a homicide. The charge will be murder OR manslaughter. The charge that goes forward will be the one that the prosecution needs to prove. He will be found innocent or guilty. If the judge sends forth "murder" charge, then he is guilty or innocent. I really don't know for sure. There is the option of a "lesser charge" than murder...maybe. Too many rules and wiggle room for an aquittal.
Under the system they are working under, if this judge finds that there is enough to charge the cop with Murder, but the jury in the trial finds that it was an accidental manslaughter, does the cop walk out of jail a free man?
Yes. The DA brought the charges, but here the judge decides what level of charges. Unfortunate. I think it's a murder charge because he was murdered with in a malicious nature. It is clear that Grant was subdued and did not pose a threat.
Are you serious? suing for 50 million dollars? lmfao!!!!1 they wont get even close. I do understand why they are suing the cop but 50 million??!! hahahahahha greedy. And the other cop that is being sued for punching oscar grant.. THATS STUPID.. OSCAR GRANTED TRIED TO KNEE THAT COP IN THE GROIN!!!!!!!!!! GEEZ
