Nick has to live with his actions for the rest of his life. That is far more worse than spending time in prison. I believe they were both at fault. Nick for driving recklessly and John for not putting on his seat belt. Who knows what the outcome would have been if her were wearing it.

How The Hell can anyone put sole blame on Nick? The other guy was drinking to! He got in the car fullling knowing they were drinking he didnt wear a seat belt! Come On People! I could see if he didnt know they were drinking and got in. But come on just as much his fault for getting in the car!
