I respectfully disagree. You have the vehicle in motion. What did you, as a police officer observe. You have the sight of the and smell of the driver. Even if the driver does not do FSB's or blow, you can still gather evidence for the DUI. In Illinois, where Ramsell is from, the driver does not have the right to simply sit in his vehicle. If a police officer deems it to be more safe for the driver to step out of the vehicle to continue the interview.
@trooperchicago - DUI is bad law to start with- we are focused on it due to a neo-prohibitionist lobby. Am I any less dead if I get hit by a driver eating a salad, holding a coffee cup while lighting a cigarette, sending a text, or a driver doing her nails? I see these things all the time, and I know the police aren't blind- they see it, too-- and they let it go. Dangerously distracted drivers are commonplace in IL, but we don't do a damn thing about it because there's more money in DUI.
You don't let the drunk driver go. You arrest based on the evidence you have, and you may lose in court, but you still arrest. You stop the person from committing the crime and maybe killing someone.
How to deal with the police: 1) don't talk, other than "I do not consent to any searches Officer" 2) don't answer questions, or the very fewest possible 3) don't be disrespectful 4) don't make eye contact 5) Do breathe 6) Do listen 7) Don't think 8) Turn off any cellphones 9) Don't try to hide your stash 10) Do call a few attorneys & hire one I could go on & on, just saved you watching the video.
Did anyone catch the incredible admission in this report? Without the FSB, the police would not have the evidence to make the charge of DUI stick. Sounds to me like someone needs to review the 5th Amendment with the police and politicians in Illinois. "What do you do? Let the driver go?" Um, yes. Sadly, the citizen doesn't have to incriminate themselves.
FSB test are a joke nobodys pass them period its all about your BAC period do not ever take the FSB waste of time either blow or not blow hired a good attorney and hope for the best!!!
The law is flawed in Illinois. The Politicians crafted bills that are feel good, but don't solve the issues. God Forbid if we asked the bar owners to stop serving people who had 3 or 4 over the limit, because that would spell disaster for the state that receives the taxes from the beers. Its a double edged sword and police are forced to do it.
