Dykes talks with Rizwaan Sabir, the masters student who was arrested under the British Terrorism Act and spent six days in custody before charges were dropped and who has awarded £20,000 by Nottinghamshire Police.

On this day, three years ago, I was asked by the Guardian to write a comment piece on my arrest and detention (and release without charge) as a suspected terrorist whilst I was conducting postgraduate research at the University of Nottingham. Exactly three years later, I am writing about the same issue, but with an element of vindication because only days ago, a three-year legal battle against Nottinghamshire police came to an end, a legal battle that I categorically won.

It started in 2008 when I instructed Bhatt Murphy solicitors to bring proceedings against Nottinghamshire police for false imprisonment and racial discrimination contrary to the Race Relations Act 1976 and the Human Rights Act 1998. A separate claim was made under the Data Protection Act 1998 relating to an intelligence file that was held on me that contained outright untruths, including that I had somehow been "convicted" of a terrorist offence. With such misinformation associated with my name, I was being subjected to frequent stops and searches.

And then, after three years of hard work, Nottinghamshire police settled out of court. Not only did they accept that there was "no evidence" to suggest that I was involved in terrorism, they agreed to pay £20,000 in damages, to pay all of my legal expenses, and after increasing pressure from my legal team, to remove all the inaccurate information that was contained on my intelligence files. They were also made to accept liability for an unlawful stop and search that I was subjected to in February 2010 and made to unreservedly apologise "for any embarrassment, frustration and distress caused" by the stop and search.

I believe this victory is very significant because it shows that the police are not, as is often thought, members of an institution that cannot be held to account. For anybody who has suffered at the hands of the police, I hope my legal challenge acts as an example that you too can fight for vindication and accountability and win. The police might not have accepted liability, but paying £20,000 and my legal fees does seem to be an acceptance of guilt in my eyes, regardless of how they spin it in their press releases.

  • @popacapnyoass Bitching? He spoke up and sought justice. There is a big difference. If he did not, then the UK government would have got away with this massive injustice. It wasn't about the money, which he should have got a hell of a lot more of, it was about his illegal detention and the fiction used to do it. All of this is because some weaselly busy body at the university he attended went ohhhhh noooo a muslim studying freely available documents, he must be a terrorist, and called the police

  • The Patriot act nullifies the constitution, ALL built in checks and balances are thrown out. Secret witnesses, trial by jury, reasonable bail, legal representation, ect.etc. This Nebulous war on terror was just a pretext to turn U.S. into a police state. Forget ignorant elections, repeal the Patriot Act, then we can speak like free people without looking over our shoulders worrying if we are going to be secretly arrested and sent to Guantanamo Bay. Fascism flourishes with fear.

  • @MajNikonfan Rizwan doesnt have to denounce sharia law. It is sufficient that he acknowledges that sharia compliant muslims of backgrounds similar to his own have a much higher propensity to commit a terrorist act than otherwise. This in turn may be the reason he suffered a long week ordeal - due to fear not racism. The ignorant usually have good instincts and every 10 year old in Britain is aware that most muslim Britons consider that the end justifies the means and are antagonistic to society

  • @MajNikonfan Sharia is already overriding British Law! There are 80+ Sharia Courts in the UK. If both litigants agree to abide by the Sharia Court ruling, it becomes law - even whence it contradicts the law of the land! I am not saying he must denounce Sharia but to ignore the obvious linkage between the terrorist threat and sharia compliance and to pretend these ignorant people who caused him his week long ordeal have no motivation besides hatred to muslims is pathetic and typical!

  • @MajNikonfan Rizwan ignores the inconvenient fact that there are dozens of radical muslims in England who are potential suicide bombers. Listening to him one would think that British Democracy is made up of racist bigots at the highest echelons who only want to make muslim lives miserable. This double standard and ungrateful attitude and total lack of Patriotic sentiment is the real motif behind Rizwan's whinging. Would someone tell him of a better way to deal with his inferiority complex?

  • @MajNikonfan Rizwan is not the first person nor the last person to fall victim to police incompetence. There are hundreds of people who experience mishaps under varying circumstances. Most people are not awarded $39,000 per week of detention/investigation so he should keep in mind that the generous sum offered and accepted by him was partly in order to make evident that there is no witch hunt against muslims in UK. Him making a career out of his ordeal opens a window to how he detests Britain.

  • @politicaltourist So Are you stating because hes British and has a Pakistani Background which in Fact he has no control over has now suddenly made him part of the problem? His freedom was taken due to the lack of research done by the police and constant childish generalisations presented by the Corporate media. You say he should also Denounce Sharia? Steady Takeover? Ofcourse I'm sure Sharia law is going to completely override the British legal system which has been around for Centuries.

  • @CTastic1 That is where you are wrong. This cost us our material stuff not what can't be replaced other than time. We will win this fight and have even better material stuff.

  • I'm not one of those people who accepts the myth of terrorism and who will allow themselves to give up aspects of civil rights in order to serve the government programme. Sorry about that.And I wasn't convinced that 7/7 was done by terrorists.

    I hate professionals who exploit their positions and discriminate against certain people.
