As a former Farmers Insurance claims adjuster I can tell you there's no way I would have found you more then 10% at fault if any % at fault since this lady turned left in front of you and failed to yield the right of way. I know so many out there have no clue what it means to yield anymore so let me sum it up for you. Yield while driving means you must allow other vehicles to pass in order to "safely manuever" whether it's turning left, right, changing lanes or merging onto a roadway.
I agree with bp2222. The moron that made the video just admited his culpability. A rear-end collision is ALWAYS the rear car's fault, according to state laws. He's lucky that he's only 40% responsible. Any insurance company would have done what Farmers did.
buddy you just said you didn't see her. So how could you have attempted to avoid. You screwed yourself on video by saying you didn't see anything. Should be 60% on the other driver but you're partially to blame.
May I suggest you contact the Insurance Commissioner's office of your state. If a car makes a left turn into oncoming traffic, it is THEIR responsibility to make sure the traffic is clear unless you failed to honor a stop sign or traffic light.

And DON'T sign the insurance company's payment for your vehicle repairs because that will acknowlege your release of their payment on the claim.
