Information Commissioner Shailesh Gandhi said that there is a lack of understanding among citizens about what information is. He said that the right to information is not a tool to get clarifications on laws or decisions on matters.
"The PIO is almost like a postman because he can only deliver what exists. Most citizens unfortunately, fail to understand this." For a good RTI application, the applicant should have asked himself where the record exists for the information that is being sought.
A lot of people don't understand that a small crisp query can achieve a phenomenal amount. A series of queries can cause confusion and put off even a pro-transparency PIO. "You don't need to establish a purpose. You don't need to give reasons." If you are able to draft an application in less than 200 words, it is difficult for a PIO to be confused or claim to be confused.
His advice to RTI applicants was to not try to go and deliver an application. Speed post is the best route. If in 30 days, you do not get an adequate response, do not try and persuade the PIO. Use the process and file a first appeal and then a second appeal. That is the best bet for success. "Most people tend to wear themselves out trying to persuade the PIO, which does not really help", he said.
