The policy was originally coined "Don't Ask, Don't Tell, Don't Pursue" What it became was "Don't Tell". Therein lies the discrimination in the law.

John McCain is lying about the fact that the military wasn't "Pursuing". It is obvious in his defensiveness and the way he shouted down the woman asking him about proven examples of the military "Asking and Pursuing". His behavior certainly smacks of misogyny.
