I think people responded to Sean Avery more than to what he did. I don't like the guy, either, but I don't see anything wrong with this. He basically traded a 5-on-3 for a 4-on-3, so it's not like he was creating an unjust advantage.

I hate when people try to manicure the game with rules like this.
