You go to the park to expect to have a good time with friends or family. When your kids play with friends and make new friends that is great but what happens when your kids play with other kids and their parents are crazy and disturb the peace? Anyway we have rights to be at the park and play like everyone else who follows the rules of the park. Signs clearly state what you can and cannot do while at the park and I am getting tired of seeing those rules being broken by ignorant people.
Also I have a copy of a little something you should know about video taping your kids or friends in a public place such as a park. An I also have some written facts about the law in regards to this woman's behavior.
As a general matter, if you videotape people in public places, even if they have not consented to being recorded, you will not be liable for a violation of "intrusion upon seclusion" because by exposing themselves to public observation, people are not entitled to the same level of privacy that they would enjoy within their own homes. Examples include videotaping a person in a public park, at a sporting event, on the steps of a government building, or at another public location. Federal and state laws, however, limit the right to record the activities of people engaged in private activities in places where they would reasonably expect to be private. If you videotape people under such circumstances, you could be liable for a violation of intrusion. For example, it is illegal in Illinois to "videotape, photograph, or film" people without their consent in "a restroom, tanning bed, or tanning salon, locker room, changing room or hotel bedroom.
(1) Disorderly Conduct:
Now as for disorderly conduct this is some information on that:
The elements of disorderly conduct vary from one jurisdiction to another. Most statutes specify the misconduct that constitutes the offense. Acts such as disrupting the peace or causing a nuisance, yelling and shouting to disrupt the peace, the use of vulgar and obscene language in a public place, vagrancy, loitering, causing a crowd to gather in a public place, or annoying passengers on a mode of public transportation have been regarded as disorderly conduct by statute or ordinance. The offense is not committed unless the act complained of clearly falls within the statute.
(2) Public Disturbance:
The offense of public disturbance is usually defined as a misdemeanor. State and local laws governing public disturbances vary, so local laws should be consulted for specific requirements in your area. Some of the activities which may constitute a public disurbance include: 1. Loud noise; or
2. Offensive language addressed in a face-to-face manner to a specific individual and uttered under circumstances which are likely to produce an immediate violent response from a reasonable recipient; or
3. Threatening to commit a felonious act against any person under circumstances which are likely to cause a reasonable person to fear that such threat may be carried out; or
4. Fighting, Yelling, shouting, hooting, whistling or singing on or near the public streets, particularly between the hours of eleven p.m. and seven a.m. or at any time and place as to unreasonably disturb or interfere with the peace and comfort of owners or possessors of real property;
(3) Defamatory and slanderous remarks:
In common law jurisdictions, slander refers to a malicious, false and defamatory spoken statement or report, while libel refers to any other form of communication such as written words or images. Most jurisdictions allow legal actions, civil and/or criminal, to deter various kinds of defamation and retaliate against groundless criticism. Related to defamation is public disclosure of private facts, which arises where one person reveals information that is not of public concern, and the release of which would offend a reasonable person. "Unlike [with] libel, truth is not a defense for invasion of privacy.
If you put the three together you can see that we are within our legal rights to file a complaint against the person who perpetrates the misconduct.
So if you have kids and you want them to have fun and they happen to run into some of their friends who also want to play with them in a public place such as a park then be prepared to deal with parents who could have issues and cause a big scene over nothing worth making a scene over.
