On November 7, 2009, at 8:03:09 PM, a Mercedes S550 sedan, driven by Chris Dietrich of Doylestown, PA, and owned by Stephen Worth, owner of Worth & Company, who was also in the vehicle, went through a red light and hit my blue 2001 X5 SUV.

Chris Dietrich lied to officers, who arrived at the scene about 30 minutes later, and lied on his recorded statement to the Chubb Insurance adjuster, claiming he had he green light. As a result, Chubb, who insured the Stephen Worth's Mercedes, denied my claim.

Facing having to pay the $1,000 deductible to repair my vehicle (which has approximately $5,000 in damages), I tracked down a security video which covered the intersection, which is 11th Avenue and W 41st Street, in New York, NY.

In the video, at time 20:03:09, the accident occurs. This is at time 2:43 of the video itself.

While the impact occurs just off camera, it's already been established that it did happen from the police report, and the video shows the two vehicles converging. My vehicle is on 41st St (right to left, on top of video). It is the blue SUV that turns left. Stephen Worth's Mercedes enters the intersection, coming down 11th Ave, a split second before my vehicle does so.

The 41st St light is on a 40 second cycle. This means 11th Ave has a red light for a full 40 seconds (this includes 41st Street's green and yellow light, plus the time both directions have a red light, on the front and back end of the cycle). Stephen Worth's Mercedes enters the intersection at 20:03:08. Traffic on 11th Ave starts moving again at 20:03:40. This is a 32 second differential.

To demonstrate the 40 second cycle, if you go forward to 20:04:32, you will see traffic on 41st St starts moving, indicating the light just turned green on 41st St. Traffic restarts on 11th Ave at 20:05:10, indicating 11th Ave just got the green light. This is a differential of 38 seconds (the remainder of the 40 second cycle being the dual red lights at the beginning of the cycle). This proves that at the point that Stephen Worth's Mercedes entered the intersection, I had had the green light for approximately 6 seconds.

  • nope, didnt go to the police. they were barely interested in taking the initial police report. the arbiter decided for 50/50 split, so i got half my deductable back, but all the lying, delays, and uncertainty cost me at least 5,000. more to follow...
