How does an attorney prove liability in a wrongful death lawsuit in New York? The key with any personal injury or death lawsuit is proving that someone was careless and caused injury or harm to someone else. One of the key ways to do that in a wrongful death case in New York is to look at what the autopsy showed.

An autopsy is a thorough examination of the person who died by a medical specialist known as a pathologist. The pathologist will reach conclusions about the cause of death that can help or hurt a potential wrongful death case.

If we know what the precise cause of death was, we can then look at the facts surrounding the death to determine whether or not the actions were appropriate or negligent.

A complete review of your medical records leading up to the death is also critical. Talking with witnesses is also important to determine liability.
