All the 4 post election violence suspects, whose charges were confirmed last Monday by the ICC Pre-Trial Chamber, have filed applications for appeals against the ruling. Deputy Prime Minister Uhuru Kenyatta and immediate former Head of Civil Service, Ambassador Francis Muthaura filed their applications on Friday last week, while Eldoret North Mp William Ruto and radio journalist, Joshua Arap Sang filed their applications Monday, just before the expiry of the 5 day deadline. However, according to the ICC rules of procedure, it is the same Pre-Trial Chamber that confirmed charges against the four, that will determine whether the applications will proceed to the appellate chamber, a situation that could dent their hopes of avoiding their day before the trial chamber.
