The officer was criminally charged after a complaint was made and a secretly recorded video was given to the Special Investigations Unit (SIU) showing OPP officer Ludgero Café brandishing what appear to be 2 dildos at an OPP police station in Toronto. With the dildos in hand, the officer tells a man "which one do you want?" and "...if you ever end up going to jail...in a nice mostly dark place that you have...That's exactly what Bubba's gonna do to you. I will personally send a nice [inaudible] to take care of you in there."

The incident took place on March 12, 2012 at the OPP police station at 2682 Keele Street in Toronto. The man was at the station for fingerprinting after being charged with an utter threats. That charge was later withdrawn.

After an investigation the SIU recommended that a charge be laid against officer Café for Uttering a Threat to Cause Bodily Harm, contrary to s. 264.1(1)(a) of the Criminal Code of Canada. (see http://www.siu.on.ca/en/news_template...)

But on February 1, 2013, at the 1000 Finch Avenue West court house, Crown prosecutor Ian Bulmer withdrew the charge.

The complainant, Jagdis Tirbany, a 45 year old resident of Toronto is very disappointed with the decision. "Just because he has a badge on -- he abused me and he got away with it. Who's protecting me? The same people that abused me? "

Tirbany has also made a complaint to the Office of the Interdependent Police Review Director (OIPRD) about the conduct of 3 officers, including Café, and expects a written report in the next few weeks. The officers may face job discipline. The complaint alleges that 2 other OPP officers witnessed but failed to report the incident.

Mr. Tirbany expects to file a lawsuit against the OPP with the assistance of lawyer Davin Charney. The lawsuit will allege sexual assault, intimidation, and wrongful interference with Mr. Tirbany's tow truck business. The claim is expected to outline a pattern of harassment by OPP officers against Mr. Tirbany including falsely arresting him on one occasion and threatening to arrest him on other occasions.

"It appears that the officer did not act alone, he acted in front of other police officers who stood by and did nothing but laugh" said Davin Charney. "This shows a culture of corruption in the police, a culture of lawlessness and lack of accountability. How can we trust these officers to uphold the law? "
