Kingman AZ Friday 18th 2009 around 4.45 pm Downtown on Andy Divine National Guard perfoming "police" duty, providing "security' and directting traffic.
We support our soldiers and troops but we do not support the unlawful deployement of our soldiers on US soil, to "police" the Citizens... A clear violation of the The Posse Comitatus Act
Section 1385 of Title 18, United States Code (USC), states:
Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress,
willfully uses any part of the Army or Air Force as a posse comitatus or otherwise to execute
the laws shall be fined under this title or imprisoned not more than two years, or both.

Why and Who is permitting this "unamerican" precedent and violation of the law in Kingman?
Are we living in a Police State City?

  • Get a life! In Ireland our equivalent of the National Guard, the Army Reserve, have provided unarmed security at various events, they also help search for bodies, erect barriers for floods and whatever else is required of them.

    We are not in Ireland... we are in America...and we have God Given Rights... a Bill of Rights and we carry legally guns in Arizona without "permits"... because we are nobody's slaves.

  • The National Guard is not held under Posse Comitatus unless federalized under Title 10 USC by the President. They can, however, operate along side state and local law enforcement under Title 32 USC if called to do so by that states governor.

  • @VIVIEN2005 The US Army / US Airforce National Guard do not fall under the US Consitution's "US Military", they fall under "Militia".

    Being in the National Guard for the last 15 years, I can tell you that it's much cheaper to use us for traffic details, than it is to pay cops overtime. Also, being a STATE RUN ORGANIZATION, that is under the control of the Governor, we can be used in ANY situation like traffic control for a race (Massachusetts does it every year for the Boston Marathon, no one here cries about it).

  • @mohaveminutemen posse comitatus applies to federal forces as i understand it. these national guardsmen are under state control and constitute a citizen militia.

  • I hope this woman never needs the National Guard during an emergency.

    Posse Comitatus only applies to Department of Defense. The president cannot (or shouldn't) be able to mobilize the Guard to do anything state side. The state governors can do anything they want with them. They're the successors to the state militias and their main job is actually augmenting police and rescue teams, like it or not.

    Federal law enforcement, like the Coast Guard are also not covered by Posse Comitatus.

  • @unclewolfeire It states clearly in our Constitution that the United States military is not allowed to police United States citizens. They have no authority inside our borders.
