Even though that incumbent (Mumbles Menino) ran an administration that was properly sued by Kevin McCrea and they (Flaherty) lost for failing to adhere to public meeting laws.
The case is ongoing in Suffolk Superior Court and not one councilor has had to actually appear in court.
When the lease ends in 2013, Millennium can walk away, and get first right of refusal to buy the land for the same price, $23 million. The documents have also mentioned a 121A tax break. And I assume the 150 zoning will be nullified, either by the 121A or because the use of BRA land makes it a U-District no zoning, only negotiation with the BRA.
The BRA conducted a competitive bid for the parcel, and a qualified bidder had offered $23 million, proposing to build 340 housing units on the site. The BRA let Millennium match the bid and then never made them buy it.They gave Millennium a 10-year lease, taking a $13 million pre-payment which was supposed to be used for the upper school that the site was slated for, but the money has been sitting in a BRA escrow account collecting interest.
The developers are Millennium Partners from New York, with local MDA Associates.
The developers don't have to pay property taxes because the BRA now owns the land. All BRA land, billions of dollars worth of property, is tax-exempt (the Mayor demands no Payment in Lieu of Taxes, although he could). The BRA took it by eminent domain from the City of Boston, without paying any compensation, on Mayor Menino's instructions; he simply wrote a letter.

Millennium: gets to tie up the land for a decade to prevent competition while they sell their condos with no property taxes
Menino: gets to help a favored developer
City Council: gets another black eye for doing nothing. They all know about it, they've had hearings. They do nothing.
