Okay, let's suppose you send him to jail for two years. That means he gets labeled a convicted felon a sexual predator for the rest of his life. When he gets out of jail, what's he going to go back to? He'll have no family, no job; he'll be a total pariah. Question: is he more or less likely to re-offend than someone who got convicted of a misdemeanor and got court-ordered psychotherapy?
