McWhorter says affirmative action is only justified in cases where discrimination or concrete obstacles are demonstrable. This does not mean the playing field is leveled; we will never have an entirely equal society. But beneficiaries of affirmative action do not have to reach equal levels as others. They only have to reach the bar set by policymakers to gain the fruits of affirmative action. The fact that were even having a debate like this signifies that the rationale for affirmative action has fallen apart and we need to move on. Bollinger asks why the many other factors considered in admissions, such as alumni connections or geographical diversity, are not attached with the same stigma. He also points to the success of non-educational institutions like business or the military who have also seen the value in considering race in order to achieve greater diversity.
