The traffic accident occurred on June 11, 2009 on the I-40 EB at the 141 MM right at the entrance to the weigh station. The extrication took nearly 2 hours from the time the first 9-1-1 call had been received. The driver of the Food Lion truck was killed upon impact.
Units responder were Iredell County IMED 1 & 9, Iredell County Rescue, West Iredell Fire Dept, Monticello Fire Dept, Troutman Fire & Rescue, Catawba Co Station 8, North Carolina State Highway Patrol, State Medical Examiner's Office, and Cross Carolina.
I drive trucks based out of nc and i dont care what the law says if the weigh station is backed up onto the interstate and the sign says open im going straight through. They are just going to have to catch me and give me a citation. Then them and my company can talk to my attorney

This accident should be enough evidence to show that you should not be forced to get off the road to pull into the weigh station when trucks are backed out beside the road.
NC law states if the sign says open you must pull in. Most likely..the Food Lion driver didn't want to pull off but feared being given a citation if he didn't. If he had been given a citation,he would have lost his job.
The DMV officers operating this station should have been made to compensate the family for their loss.
