The Supreme Court has lifted suppression on a portion of David Bain's 111 phone call in 1994 in which he apparently confesses to shooting someone.

His defence team has lost a last ditch bid to keep the tape secret.

On the tape, Bain is allegedly heard to say "I shot the prick".

The Supreme Court had earlier ruled the recording not be played to the Christchurch jury that found him not guilty of murdering five family members last week.

A number of media organisations argued in the Supreme Court in Wellington on Thursday morning for suppression on some parts of Bain's 111 call to be lifted.

Personally, I heard "I can't breathe".

As for why the defence didn't want it heard - isn't it obvious? Once you have been primed to hear "I shot the prick" that's what you're going to hear. The defence, and the Supreme Court, agreed that this would be unfairly prejudicial on the case when the evidence was very slim, This is especially so when many supposed experts disagreed on what was said.

@Allandrover So am I. I've been certain since I first heard it played and never wavered. Can't believe how few people can hear it. Everyone hearing 'I shot the prick' or 'I can't breathe' must be partially deaf and those who say there aren't even words there, must have a few screws missing.

what the fuck? he didn't even say anything! this isn't anything! and if it was it's far closer to i can't breathe till i shot the prick... that's not evidence that's heavy breathing.
