The High Court has temporarily halted the swearing in of the five Supreme Court judges appointed by President Kibaki on Wednesday. Justice Jean Gacheche issued the order after six women's organizations sought the court's intervention alleging a breach of the constitution with regard to gender equity and equality. The lobby groups went to court citing constitutional provisions that require that no more than two thirds of elective bodies shall be of the same gender. President Kibaki has already gazetted the appointments of Justices Philip Tunoi, Jackton Ojwang, Mohammed Ibrahim and lawyers Dr. Smokin Wanjala and Njoki Ndung'u to the coveted posts of judges of the first ever Supreme Court in Kenya.
