For example, if a student does not take any of his final exams and gets Fs in all his/her classes and is dismissed academically by McDaniel, they can notify a parent by email, phone and/or certified letter of this course of action WITHOUT THE CONSENT of THE STUDENT. FERPA doesn't state it is not allowed. McDaniel chooses not too. REREAD FERPA 99.31(A) AND STOP MISLEADING PARENTS. Change your policies!
McD needs to reread FERPA 99.31(a).Nothing in this section prevents an educational agency or institution from disclosing education records or other personally identifiable information from education records to a PARENT WITHOUT THE PRIOR WRITTEN CONSENT of the ELIGIBLE STUDENT if the Disclosure MEETS THE CONDITIONS in 99.31(a)(8), 99.31(a)(10),99.31(a)(15) OR ANY OTHER PROVISION of 99.31(a).IRC Section 152 of Title 26 of the US Code(Dependent Student). FERPA allows,but McD chooses not too. Why?
Wake up McDaniel...FERPA does not prevent parents from being notified of Academic Probation, Academic Dismissal, Drug or Alcohol Violations,etc. Colleges are misleading parents about their rights. You didn't even address IRS Section 152, ie, proof that parents are claiming their child as a dependent, allows parents access, even if the child has not signed a consent form for release.
