  • Canada eh ? They should let this guy off AND give him a ATC to protect himself from the assholes when they do get out of prison for attempted murder. Oh wait, it is Canada after all, they'll get house arrest and a free lawyer to sue the poor guy for daring to protect himself. I love my countries laws.

  • The man should be a shining example of how to preserve your own and your family's lives when the police station isn't attached to your house. Instead they are making an example of him in the absolute wrong way while teaching criminals that regular citizens have been neutered of any right to fight back. Hell home invasion sounds a hell of a lot safer than my construction job. Think it's time for a career change.

  • The Niagara Regional Police have charged a man who obviously was being attacked and was afraid for his life. Why did they charge him?

    PS. It is now March 3,2011 and two of the four charges were dropped.

    Why were the other two charges not dropped?

  • @smokechecker300 The Common Law operates in full vigour in Canada, however the concept of "equity" which became popular sometime in the late 18th and 19th centuries began to stifle our Common Law Rights. I would also argue that if it is in a written reason for judgment, it is "stare decisis" no longer implicit. Courts have held we are under no obligation to retreat from threat.

  • @smokechecker300 Sorry for the late reply,,However no,, castle doctrine is entrenched in Common Law, which is in fact the only true law in Canada, Acts of Parliament are not laws. We don't have law makers, indeed it is impossible for them to make law. The Parliament of Canada is a legal fiction a corporation created by the English Parliament (another legal fiction). The Maxim in law is that " The law may give rise to a fiction, however a fiction may not give rise to law.

  • yes,im sick of this shit.If people stopped being such cowards and took responsibility for their safety it would be a much safer country.the media keeps using tradgedies to con pussies into thinking disarming people is a good idea.how hard is it to understand?criminals dont obey laws,and disarming someone that would save your life is even dumber.

  • A great example of politicians and police looking after their own and having little to no regard for taxpayers. Hopefully this will be resolved and serve as a positive precedent, otherwise it will be nothing more than another message to criminals to carry on, as citizens have no recourse to retaliate. Apparently as Canadians, our only right is lie patiently hoping the police arrive before we are slain. WIth a wife and child at home, I would have done the same, or worse. Better charged than dead.
