COVERUP, DELAY, LOSS OF PUBLIC INTERREST, BACK PAGE EXONERATION, CIVIL SETTLEMENT WITH " NON DISCLOSEURE CLAUSE.
To hire a Police Officer Defense Attorney who works for the County of L.A. and is paid by the people who pay out the wrongful death claims is ludicrous at best. There is no need to analyze the City's manuals, or training or if the Officers weren't breast fed. There is no need to reinvent the wheel. None of that has a bearing on six men beating another man to death under the Color of Authority.
THE PURPOSE OF AN INTERNAL AFFAIRS INVESTIGATION, IMMEDIATELY, IS TO PRESERVE THE TRUTH OF THE INCIDENT AND TO EXONERATE OR PROSECUTE CRIMINAL POLICE CONDUCT. FAILURE TO FOLLOW THE BELOW PROTOCOL INDICATES COVERUP.
1. All involved Officers are separated immediately. Vehicles, Police Clothing and equipment and the crime scene are secured. Forensics begin. Videos by the City are released to the Investigation. Witnesses are interviewed and their videos are requested. Officers are advised to discuss the situation with absolutely no one except their Attorneys "AFTER THE RECORDED IA INTERVIEWS".
2. Officers are instructed that they must tell the entire truth in Internal Affairs interrogation. Failure to do so or enacting their 5th Amendment will result in immediate termination without the right to Appeal. Public Employees have no right to any defense against investigation by their Public Employers. They may at the City Attorney's discretion , have the POA Attorney present or their own. Those Attorneys may not speak or converse with the Officer. Nothing said in that Investigation can be used by anyone in a Civil or Criminal trial or Investigation.
3. The Autopsy is completed with a definitive "Cause of Death".
4. All evidence including all recorded Statements is reviewed. The sequestered Interrogations are reviewed. The Chief of Police with his IA staff, the City Attorney and his Command Staff review all evidence and the past IA files on each Officer. A recommendation is made for Exoneration, Suspension or Termination. The City Manager and Human Recourses reviews and returns their recommendations to the Chief. The Chief issues the results to the Officers including Termination Letters.
5. The package is supplied to the District Attorneys Office Investigators and when they finish they make recommendations to their DA.
6. An open Grand Jury is formed and the District Attorney's job is to present evidence and request an Indictment where justified.
7. Warrants for arrest are issued and self surrender is allowed. Booking and Bail occur and the Case is set for trial. A Jury of the Officers peers sit in judgment. If convicted and sentenced there are special secure prisons set up to incarcerate Police Officers for safety.
8. Release with or without parole takes place.
None of this has occurred to date in the Fullerton Police Department. and it is impossible to do it now. Instead, all of the aforementioned people have been working day and night to hide, obstruct and Defend with lies the actions of these killers. I could not sit on their jury, my 40 years in Law Enforcement and the evidence I have reviewed and the deceit I've watched tells me this is open and shut.
