Man i am sorry to tell you, but look up Terry V. Ohio, it is a supreme court case specifically dealing with this issue, if you look suspicious they have the right to search, the best thing to do when they search you is just smile and be nice. Oh and some states have laws that when an officer asks to to identify yourself you must do so.

Thank youvery much for that. We are mostly oblivious of these rights that no where else on earth are afforded.. The 4th & 5th & 2nd are for the people and states & washington wittle away at them continously and we need to fight for them or the politicians will weaken them to the point of masrshal law. THIS IS AMERICA-LOVE IT & make sure you know the position of the politicians you vote for, Our constitution is being taken lightly. This is why you need to vote &vote for the right reason!

The Fourth Amendment is not a protection against searches and seizure, but from "unreasonable" search and seizure. To learn the definition of what a search, and a what a seizure is and what makes them unreasonable you need to read good case law as handed down by the Supreme Court. You also failed to discuss the valid exceptions to the warrant requirement such as: Search incident to arrest, automobile exception, plain view, consent, stop and frisk, hot pursuit, administrative searches, good faith

A lot of this guys information is wrong. There's a difference between a search and a pat down. But he is blending them together which makes me question his credibility. He also needs to read law because he actually is not allowed to say "whatever the fuck" he wants. Slander and abuse laws. Again, get your information right sir.

no disrespect but while your reading up on your bill of rights u should also read a little case law. According to terry vs. Ohio a police officer has the right to stop and frisk a person on the grounds of reasonable suspicion. Reasonable suspicion meaning if they feel you are a treat to them or the public they can stop you and search you if they feel necessary.

That still would bring up the question of what is "Reasonable suspicion". What is considered a threat? Is walking down the street doing nothing a threat?
According to the law "Warrants must be supported by probable cause and be limited in scope according to specific information supplied by a person (usually a law enforcement officer) who has sworn by it and is therefore accountable to the issuing court."
Paper work or not it must be justified not just any random suspicion.
