well i looked it "DUI/Manslaughter: Second Degree Felony not more than $10,000 fine and/or 15 years imprisonment" that is floridas law on it so yea maxium penalty is 15 years in jail if you hit and run on it maximum is 30 years nothing like murder... so i think the judge definatly took into consideration that it was not really his fault, he already had settled with the family, he did not flea, he admitted to it which resulted in only 30 days jail but what ever he got he still has to live with it
haha I'll agree with you on that one. doesn't a lot of your punishment lie on what the judge decides though? like with some DUI Manslaughters (if its 100% entirely their fault) can't you get months or in the same case decades?
laws very by state i live in ohio and i know for a fact (not by expiernce) that the first DUI (not dui manslaughter) you get 3 days in jail and possible fine, 2nd time is up to 30 days in jail and bigger fine and posible suspension, 3rd time is jail fine and suspension.
what i am saying is he should not have gotten charged with dui manslaughter, that guy did an illegal action which caused his death. if it were a regular joe like us we would not get dui manslaughter just dui and maybe speeding
the law does not state first DUI manslaughter (whether you plead guilty or not) that you don't get any jail time...you serve heavy time if your blood alcohol content is .12 (legal limit .08) and you are speeding (10 miles an hour over the limit) and you kill someone.
about drunk driving. there was an incident in denver where a guy was not drunk but hit a guy crossing the street the same way to catch a bus and the guy that hit him did not get a ticket but the guy that got hit got a jay walking ticket so seriously he got what he got only because he is a star. if it were me or you on a first offense there would be no payout to the family there would be no jail time except the 3 days required for 1st offense and maybe a fine but that would be it
1. he got 30 days in jail for the DUI ticket which we all get for a 2nd DUI ticket so realy the 30 days is for the manslaughter
2. it was also a plea bargin being that he admitted to it so instead of going through trial and possibly getting DUI manslaughter and speeding he got DUI manslaughter at a lower sentence because he admitted it the fact that the guy he killed crossed the street illegaly. and only got the DUI manslaughter is beacause he is an NFL star and they wanted to make a statement
there is no justice in the justice system. If it was you or I, we'd get at least the minimum sentence no matter what the situation is, but since its an NFL athlete, he gets away with DUI Manslaughter. Dante was also speeding as well, so if he is drunk and speeding and kills someone, don't you think he is responsible for the death of this man?
based on the police report and witness statements that were released and they all said that the dude did not use a cross walk and ran out in the middle of the street to catch a bus look it up
