    I'm not referring to cases where there's a conflict of laws issue.

    I'm talking about when the first-instance question is a matter of federal law.

    (Note: Although Canada is a federation, it has a unitary judiciary--we don't have separate "provincial" and "federal" judiciaries. So I find the American approach weird, alien, and extremely interesting.)

    Nope. Federal courts only apply the "substantive" law of the state in question, if indeed there is a state issue in question, and not NOT "procedural" law of the state (like its voir dire process or jury selection/eligibility). But don't trust me; I'm only a second year law student :P

    Regardless of the jurisdiction, and whether it's technically permitted, it's unusual for police officers, lawyers, judges, etc. to make it through voir dire without getting struck for cause. But it has been known to happen, at least in the US. My criminal law professor said that she once sat on a jury in which the judge was a former law student of hers! It was many years since she taught him (she's in her 80s), but it's still very surprising.

    Okay, well, that's clearly a matter that will vary by jurisdiction.

    I'm from Alberta, Canada, and our Jury Act specifically excludes police officers, lawyers, judges, and so forth from eligibility.

    I probably over-reached a little in assuming that the same would be the case everywhere.

    Except for the fact that lawyers, judges, and police officers are eligible. Though they rarely get through voir dire, it happens. The dean at my law school was on a jury actually.

    As a general rule, they want jurors to come into things with a completely clean slate. This is why lawyers, judges, and police officers are not eligible for jury service.

    They'd rather not have people coming in with preconceptions as to criminal procedure and the substantive law.

  • depends on how you put it. usually that bluntly could get you a contempt of court charge. There are easier ways of getting out of it. remember, too, that what you state becomes public record.
