May 1992, I enrolled in 1-month trial membership at Bally Fitness; never returned after it expired. In July 2009 I received a letter (in my maiden name -- scary) seeking $1,200 in fees. Phony debt; fine print? 1992-1999 Bally never attempted to collect payment. Debt was purchased in Oct 1999 by a company that never sought a dime from me until they sent me that letter in July. I called them, cited that the statute expired; they agreed, and said "OK" when I (legally) refused to pay.

Some companies purchase old debts for pennies on the dollar and then demand payment on debts that have gone past the 7-year statue of limitations, cannot affect your credit report! These people are breaking the law, engaging in unethical practices hoping you will pay. Some debts are decades old and the long cold dead! Any amount of payment will start up the statute of limitations again and make you responsible for the entire amount. Get educated, protect yourself from these bloodsuckers.

Just one little correction: you said the collection agency has five days to send you a letter from when they get the account. The correct statement is the collection agency has five days to send you the letter once they get in contact with the consumer..

This**only** applies to collection agencies sorry, but the original creditor?  The FDCPA doesn't apply because they are not a collection agency.
